These Terms and Conditions govern your use of CamXcellence Ltd's website and services, including training, coaching, consultancy, assessment and career services. By purchasing or using our services, you agree to these Terms.
1. About CamXcellence Ltd
CamXcellence Ltd provides professional development, learning, coaching, consultancy and related online services, including Lean Six Sigma training and consultancy, Operational Excellence consultancy, Business Process Management, Project Management training, Change Management, ISO/audit training, Leadership and Executive Coaching, Career Coaching, 360° Feedback, CV writing and ATS optimisation, LinkedIn optimisation, job application support, interview preparation, assessment and succession services, AI resources, and online courses, workshops and consultancy. Specific services may have additional terms or service-specific agreements.
2. Who We Contract With
CamXcellence Ltd may provide services to consumers (individuals purchasing for personal use), businesses and organisations, and professionals and learners. Where a service is purchased by an organisation on behalf of an individual, the organisation may be the contracting customer while the individual is the service participant. Different legal rights may apply depending on whether you are acting as a consumer or business customer.
3. Service Description
We will provide the service substantially as described on our website, proposal, booking page, quotation, statement of work or other agreed documentation. We reserve the right to update course materials, improve platforms, change trainers or consultants where reasonably necessary, and correct errors or omissions in published information. Where a material change substantially affects a service already purchased, we will provide appropriate notice and remedies where required by law.
4. Formation of Contract
A contract is formed when you place an order or booking and CamXcellence Ltd accepts it, when payment is made or authorised, or when both parties sign a proposal or statement of work. For business consultancy projects, a signed proposal may contain additional commercial terms which will generally take precedence for that specific service.
5. Prices and Payment
Prices will be displayed in the applicable currency or provided in a quotation, which may be stated in GBP (£), AED (د.إ), USD ($) or another agreed currency. Unless expressly stated otherwise, prices exclude applicable taxes, VAT, duties or other governmental charges. Payment may be made through approved payment providers displayed on our website. We may suspend access to a service where payment is overdue, subject to applicable law.
6. VAT, Taxes and International Charges
Where applicable, UK VAT, UAE VAT or other taxes will be charged in accordance with the law applicable to the transaction. International customers may be responsible for local taxes, withholding taxes or customs charges applicable in their jurisdiction. CamXcellence Ltd does not provide tax advice.
7. UK Consumer Rights
Where you are a consumer in the UK, nothing in these Terms is intended to remove or restrict rights that cannot legally be excluded. Where applicable to an online distance contract, consumers may have a 14-day cancellation period, subject to statutory exceptions and the nature of the service. Nothing in these Terms affects your statutory rights.
8. Cancellation and Rescheduling
Specific cancellation conditions may apply to individual services. For coaching, consultancy, assessment and one-to-one appointments, customers should provide reasonable notice if they need to reschedule. Where a customer cancels with insufficient notice or fails to attend, CamXcellence Ltd may charge an applicable cancellation fee, subject to applicable consumer law.
9. Training Courses and Workshops
For training programmes, participants are expected to attend scheduled sessions, complete required activities, participate professionally and comply with trainer and platform instructions. Completion of a course does not automatically guarantee employment, promotion, salary increases, professional accreditation, examination success or certification from an external awarding organisation. Where an external certification body is involved, its rules and requirements will also apply.
10. Coaching Services
CamXcellence Ltd coaching is designed to support professional development, career development, leadership capability and personal effectiveness. Coaching is not medical, psychological, psychiatric, legal, financial or therapeutic advice, and does not guarantee any particular career outcome, promotion, employment, salary or business result. The customer remains responsible for decisions they make following coaching.
11. Career, CV and LinkedIn Services
We use reasonable professional skill and care in delivering CV writing, ATS optimisation, LinkedIn optimisation and related services. We do not guarantee that a customer will obtain an interview, receive a job offer or promotion, or pass an ATS. Recruitment decisions remain entirely under the control of employers and recruiters, and ATS systems vary between organisations and software providers.
12. "We Apply, You Prepare" Service
Where CamXcellence Ltd provides application support, the customer is responsible for ensuring that all information supplied is accurate, truthful, current, complete and legally permissible to submit. We will not knowingly submit false, misleading or fabricated information, and do not guarantee that an application will result in an interview or employment.
13. 360° Feedback and Assessment
360° feedback and assessment services are designed for development, leadership and organisational purposes. Feedback is intended to support development and should not automatically be interpreted as a formal performance appraisal, disciplinary finding or psychological diagnosis unless expressly agreed and designed for that purpose.
14. Consultancy Services
Consultancy services will normally be governed by an agreed proposal, statement of work or consultancy agreement. Unless expressly agreed otherwise, consultancy recommendations are advisory. CamXcellence Ltd does not guarantee a particular financial, operational or commercial outcome. The customer remains responsible for decisions relating to implementation.
15. No Guarantee of Results
Outcomes can depend on factors outside our control. Unless expressly stated in a written agreement, CamXcellence Ltd does not guarantee employment, promotion, examination results, certification, financial savings, revenue growth, productivity improvements, business transformation, investment returns or specific coaching outcomes.
16. Customer Responsibilities
You agree to provide accurate information, attend appointments on time, complete agreed actions, maintain appropriate internet and technology access, protect your account credentials, comply with applicable laws, and treat CamXcellence Ltd staff and other customers respectfully. You must not use our services for unlawful, fraudulent, abusive or misleading purposes.
17. Intellectual Property
All intellectual property contained in the CamXcellence Ltd website and services belongs to CamXcellence Ltd or its licensors, including course materials, presentations, frameworks, templates, methodologies, graphics, trademarks and assessment materials. You receive a limited, non-exclusive, non-transferable right to use purchased materials for personal or internal organisational purposes only. You must not, without written permission, reproduce, resell, distribute or upload our materials, or create competing commercial products from them.
18. Customer Materials
You retain ownership of documents and information you provide to CamXcellence Ltd. You grant CamXcellence Ltd the limited rights necessary to use those materials to provide the contracted service, and confirm that doing so does not knowingly infringe another person’s rights.
19. Confidentiality
Where confidential information is shared in connection with a service, each party will take reasonable steps to protect that information. CamXcellence will not intentionally disclose confidential customer information except where required to provide the service, authorised by the customer, required by law, or necessary to protect rights, safety or security.
20. Data Protection and Privacy
CamXcellence Ltd processes personal information in accordance with applicable data protection legislation and our Privacy Policy, which explains what personal information we collect, why, how long we retain it, who we share it with, and your privacy rights.
21. Online Services and Third-Party Platforms
CamXcellence Ltd may use third-party providers for video conferencing, learning management systems, payment processing, scheduling, cloud storage and other services. Third-party providers may have their own terms and privacy policies. CamXcellence Ltd is not responsible for outages or failures caused solely by third-party platforms beyond our reasonable control.
22. AI and Technology
CamXcellence Ltd may use artificial intelligence and automated tools in connection with certain services or internal processes, and will take reasonable steps to use them responsibly. Customers should not submit highly sensitive, confidential or third-party personal information to AI-enabled tools unless specifically instructed and authorised. AI-generated information may contain errors and should be reviewed before being relied upon for significant decisions.
23. Website Content and Knowledge Hub
Our Knowledge Hub, blogs, AI resources, guides and other public content are provided for general educational and informational purposes only. They do not constitute legal, immigration, financial, investment, medical, tax or other regulated professional advice.
24. Third-Party Links
Our website may contain links to third-party websites provided for convenience or information. CamXcellence Ltd does not control third-party websites and is not responsible for their content, availability, security or privacy practices.
25. Website Availability
We aim to keep our website and online services available, secure and functional, but do not guarantee uninterrupted availability. Services may occasionally be unavailable due to maintenance, upgrades, technical problems, cyber incidents or circumstances beyond our reasonable control.
26. Prohibited Use
You must not use CamXcellence Ltd services to commit or facilitate unlawful activity, impersonate another person, provide fraudulent information, infringe intellectual property rights, distribute malicious software, interfere with our systems, attempt unauthorised access, or harass our employees or other customers.
27. Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including for death or personal injury caused by negligence, fraud, or statutory consumer rights. Subject to that, CamXcellence Ltd will not be liable for indirect or consequential losses. For business customers, our total liability for a particular service will ordinarily be limited to the amount paid for that service during the relevant contractual period.
28. Force Majeure
CamXcellence Ltd will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, war, government action, pandemics, major cyber incidents or third-party platform failures. Where reasonably possible, we will notify affected customers and seek to provide an alternative arrangement.
29. Complaints
We aim to resolve complaints fairly and promptly. Customers should first contact us by email with their name, order/booking reference, the service concerned, a description of the issue and desired resolution. Nothing in this process prevents consumers from exercising statutory rights or legal remedies.
30. International Customers
CamXcellence Ltd may provide services to customers located around the world. By purchasing internationally, you acknowledge that laws, taxes and privacy requirements may differ between countries, and that certain services may not be available in every jurisdiction. Mandatory local rights are not excluded by these Terms.
31. Governing Law
For UK customers, these Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections, and the courts of England and Wales will have jurisdiction. For international customers, the governing law and jurisdiction will be stated in the applicable order, proposal or contract, without excluding mandatory local consumer protections.
32. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, technology, or legal and regulatory developments. The latest version will be published on this website with its effective date, and changes will not retrospectively alter rights under an already-completed contract except where required by law.
33. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the minimum extent necessary, and the remaining provisions will continue to apply.
34. No Waiver
A failure or delay by CamXcellence Ltd to exercise any right under these Terms does not constitute a waiver of that right.
35. Entire Agreement
These Terms, together with any applicable order confirmation, proposal, statement of work, service-specific terms, Privacy Policy and Cookie Policy, form the entire agreement between you and CamXcellence Ltd regarding the relevant service, unless a separate written agreement expressly states otherwise.
